Acceptance of Terms

By creating an account, accessing, or using FitIn, you agree to be bound by these Terms of Service and any policies incorporated by reference, including our Privacy Policy. If you do not agree, you may not use the Service.

Eligibility

You must be at least 18 years old and legally capable of entering a binding agreement to use FitIn. By using the Service, you represent that you meet these eligibility requirements and that your use complies with applicable law.

Account Registration

You agree to provide accurate, current, and complete account information, and to keep it updated. You are responsible for safeguarding your credentials and for all activity occurring under your account.

FitIn may require verification measures to maintain account integrity, trust, and safety.

User Responsibilities

As a FitIn member, you are expected to:

• Use the Service respectfully and in good faith
• Provide truthful profile and identity-related information
• Respect the privacy, consent, and boundaries of other users
• Comply with all applicable laws and platform standards

Community Standards

FitIn is built for serious, fitness-oriented social connection. Members must maintain respectful behavior in profile content, direct communication, and any interactions facilitated through the platform.

We may issue warnings, suspend features, or terminate accounts where behavior conflicts with safety expectations or community integrity.

Prohibited Conduct

The following activities are prohibited and may result in immediate action:

• Harassment, hate speech, stalking, threats, or non-consensual sexual conduct
• Impersonation, fraud, phishing, or deceptive account behavior
• Solicitation, spam, scams, or unauthorized advertising
• Uploading unlawful, infringing, or exploitative content
• Attempting to reverse engineer or disrupt Service operations or security

Content and License

You retain ownership of content you submit to FitIn. By posting or submitting content, you grant FitIn a non-exclusive, worldwide, royalty-free license to host, store, process, display, and distribute that content as needed to operate and improve the Service.

You represent that you have all rights necessary to post your content and that such content does not violate law or third-party rights.

Subscriptions and Billing

Certain features may require a paid subscription. Pricing, billing intervals, and plan terms are presented at purchase. By subscribing, you authorize recurring charges based on your selected plan until cancellation.

• Subscription fees are generally non-refundable except where required by law
• Renewal and cancellation processing may be subject to app store rules
• Failure to process payment may result in plan downgrade or feature suspension

Termination

You may stop using FitIn at any time. FitIn may suspend or terminate your account, in whole or in part, for violations of these Terms, risk to user safety, suspected fraud, legal compliance reasons, or other legitimate business purposes.

Provisions that by nature should survive termination, including ownership, disclaimers, limitations of liability, and indemnification, will remain in effect.

Disclaimers

FitIn is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

We do not guarantee matches, outcomes, compatibility, or uninterrupted access to any feature of the Service.

Limitation of Liability

To the maximum extent permitted by law, FitIn and its affiliates, officers, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, reputation, or goodwill arising from your use of the Service.

Where permitted, total liability for claims relating to the Service will not exceed the amount you paid to FitIn in the twelve months prior to the claim, or one hundred U.S. dollars (USD $100), whichever is greater.

Indemnification

You agree to defend, indemnify, and hold harmless FitIn and its affiliates from and against claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your content, your use of the Service, or your violation of these Terms or applicable law.

Changes to Terms

We may modify these Terms from time to time. Material updates will be posted on this page with a revised effective date, and we may provide additional notice through the Service. Continued use after changes become effective constitutes acceptance.

Governing Use

You agree to use FitIn in compliance with all applicable local, state, national, and international laws and regulations. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
